{"id":343666,"date":"2023-10-20T17:36:54","date_gmt":"2023-10-20T22:36:54","guid":{"rendered":"https:\/\/yfile.news.yorku.ca\/?p=343666"},"modified":"2025-04-02T12:37:48","modified_gmt":"2025-04-02T16:37:48","slug":"community-update-yorks-response-to-three-student-unions-harmful-statement","status":"publish","type":"post","link":"https:\/\/www.yorku.ca\/yfile\/2023\/10\/20\/community-update-yorks-response-to-three-student-unions-harmful-statement\/","title":{"rendered":"Community update: York\u2019s response to three student unions\u2019 harmful statement"},"content":{"rendered":"\n\n\n\n\n<h3 class=\"wp-block-heading\">On Oct. 18, 快播视频 President and Vice-Chancellor <strong>Rhonda Lenton<\/strong> updated the 快播视频 community about <a href=\"https:\/\/yfile.news.yorku.ca\/2023\/10\/18\/a-community-update-our-shared-responsibility\/\" target=\"_blank\" rel=\"noreferrer noopener\">our shared responsibility<\/a> to contribute to safe and inclusive campus communities, especially in light of the need for humanitarian aid in Gaza, the ongoing loss of life, and the safety of the hostages, and the direct impact this is having on members of our University community, particularly Palestinian and Israeli students, faculty and staff, and those who have close connections to the region.<\/h3>\n\n\n\n<p>In response to a public statement made by three student unions on Oct. 12, serious concerns, outrage and fear have\u00a0been expressed by many, including students. The statement has been widely interpreted as\u00a0a justification for attacking\u00a0civilians and a call to violence.\u00a0While the University affirms the right of students and other community members to express political views, including support for the Israeli and\/or Palestinian people, the\u00a0University\u00a0has\u00a0<a href=\"https:\/\/yfile.news.yorku.ca\/2023\/10\/13\/a-statement-on-behalf-of-york-university\/\" target=\"_blank\" rel=\"noreferrer noopener\">condemned\u00a0this\u00a0statement<\/a>\u00a0noting that freedom of speech is not absolute.<\/p>\n\n\n\n<p>Despite multiple efforts to engage the student unions\u2019 leaders to address the serious and ongoing harms created by their statement, the groups have yet to take any of the steps set out by the University, and the situation remains urgent.<\/p>\n\n\n\n<p>Today (Oct. 20), the University initiated the formal process by giving a written notice to the student union leaders that we suspect they have breached their responsibilities under the Regulation Regarding Student Organizations, including failure to operate in an open, accessible, democratic, non-discriminatory manner, and failure to act in accordance with the principles of diversity, equity and inclusion for all members.<\/p>\n\n\n\n<p>The University has required the unions to take the following remedial actions or to demonstrate to the designated representative under the regulation that a breach has not occurred:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>retract the statement and remove it from all public platforms;<\/li>\n\n\n\n<li>issue a public statement to confirm that they do not endorse or support antisemitism or any form of discrimination or violence, that they are committed to the safety of the entire membership, that they acknowledge the harm done to members and to the community by the statement, and that they are committed to take steps to repair these harms; and<\/li>\n\n\n\n<li>all members of the student union executives must resign and the unions immediately hold a by-election for the vacant positions in accordance with the egulation.<\/li>\n<\/ul>\n\n\n\n<p><a><\/a><a>or<\/a><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>They must demonstrate that no breach occured.<\/li>\n<\/ul>\n\n\n\n<p>Each student union must take the remedial action required by the University, or state in writing that their position is that they have not breached the regulation, by no later than\u00a05 p.m. on Wednesday, Oct. 25. If the union denies that a breach has occurred, there will be a due process hearing to determine if there has been a breach, which could result in sanctions, the most severe of which would be the University withdrawing recognition of the union.<\/p>\n\n\n\n<p>The University is deeply disappointed that this step is now required, but we are compelled to uphold University policies and to act in the best interests of the York community, including those of the student unions and their memberships. <\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Mise \u00e0 jour \u00e0 l\u2019intention de la communaut\u00e9\u00a0: R\u00e9ponse de York concernant la d\u00e9claration dommageable des trois associations \u00e9tudiantes<\/h3>\n\n\n\n<p>Le 18 octobre, la pr\u00e9sidente<strong> Rhonda Lenton<\/strong> a mis \u00e0 jour la communaut\u00e9 universitaire de York au sujet de notre <a href=\"https:\/\/yfile.news.yorku.ca\/2023\/10\/13\/a-statement-on-behalf-of-york-university\/\" target=\"_blank\" rel=\"noreferrer noopener\">responsabilit\u00e9 collective<\/a> de contribuer \u00e0 un environnement de travail et d\u2019\u00e9tude sain et inclusif, tout particuli\u00e8rement compte tenu du besoin d\u2019aide humanitaire dans la Bande de Gaza, des pertes de vie dont le nombre ne cesse d\u2019augmenter, de la s\u00e9curit\u00e9 des otages et des r\u00e9percussions directes du conflit sur les membres de notre communaut\u00e9 universitaire, plus particuli\u00e8rement la communaut\u00e9 \u00e9tudiante, le corps professoral et le personnel d\u2019origine palestinienne et isra\u00e9lienne, et de celles et ceux qui ont des liens \u00e9troits avec cette r\u00e9gion du globe.<\/p>\n\n\n\n<p>Dans la foul\u00e9e d\u2019une d\u00e9claration publique de trois associations \u00e9tudiantes en date du 12\u00a0octobre, beaucoup ont exprim\u00e9 de graves inqui\u00e9tudes et craignent maintenant pour leur s\u00e9curit\u00e9, dont des membres de la communaut\u00e9 \u00e9tudiante. Beaucoup ont compris que, par cette d\u00e9claration, les associations estimaient que les attaques contre des civils et les appels \u00e0 la violence \u00e9taient justifi\u00e9s. L\u2019Universit\u00e9 reconna\u00eet le droit de la population \u00e9tudiante et des autres membres de la communaut\u00e9 de partager leurs points de vue politique, y compris leur appui aux peuples isra\u00e9lien et\/ou palestinien, mais l\u2019Universit\u00e9 a <a href=\"https:\/\/yfile.news.yorku.ca\/2023\/10\/13\/a-statement-on-behalf-of-york-university\/\" target=\"_blank\" rel=\"noreferrer noopener\">condamn\u00e9 cette d\u00e9claration<\/a> en affirmant que la libert\u00e9 d\u2019expression avait ses limites.<\/p>\n\n\n\n<p>En d\u00e9pit de nombreux efforts visant \u00e0 inviter la direction de ces associations \u00e9tudiantes \u00e0 prendre en compte le tort consid\u00e9rable que la d\u00e9claration avait caus\u00e9 et continuait de causer, les trois associations n\u2019ont toujours pris aucune des mesures propos\u00e9es par l\u2019Universit\u00e9, et la situation reste urgente.<\/p>\n\n\n\n<p>Aujourd\u2019hui, l\u2019Universit\u00e9 a enclench\u00e9 une proc\u00e9dure officielle par laquelle elle a inform\u00e9 \u00e9crit la direction des associations \u00e9tudiantes que nous sommes d\u2019avis qu\u2019elles ont failli \u00e0 leurs responsabilit\u00e9s en vertu du r\u00e8glement sur les organismes \u00e9tudiants (<em>Regulation Regarding Student Organizations<\/em>), plus pr\u00e9cis\u00e9ment qu\u2019elles n\u2019ont pas agi de mani\u00e8re ouverte, accessible, d\u00e9mocratique et non discriminatoire, et qu\u2019elles ne se sont pas comport\u00e9es conform\u00e9ment aux principes de diversit\u00e9, d\u2019\u00e9quit\u00e9 et d\u2019inclusion de l\u2019ensemble de leurs membres.<\/p>\n\n\n\n<p>L\u2019Universit\u00e9 a demand\u00e9 aux associations \u00e9tudiantes de prendre les mesures correctives suivantes, ou encore de d\u00e9montrer au Repr\u00e9sentant en vertu du R\u00e8glement qu\u2019il n\u2019y a eu aucun manquement&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Se r\u00e9tracter et enlever la D\u00e9claration de toute plateforme publique;<\/li>\n\n\n\n<li>Publier une d\u00e9claration confirmant qu\u2019elles ne soutiennent ni n\u2019appuient l\u2019antis\u00e9mitisme ni toute autre forme de discrimination ou de violence, qu\u2019elles s\u2019engagent \u00e0 veiller \u00e0 la s\u00e9curit\u00e9 de l\u2019ensemble de leurs membres, qu\u2019elles reconnaissent le tort caus\u00e9 aux membres et \u00e0 la communaut\u00e9 par voie de cette D\u00e9claration, et qu\u2019elles s\u2019engagent \u00e0 prendre les mesures n\u00e9cessaires pour r\u00e9parer les torts caus\u00e9s par la D\u00e9claration; et<\/li>\n\n\n\n<li>L\u2019ensemble des conseils de direction des associations \u00e9tudiantes doit d\u00e9missionner, et ces associations doivent tenir des \u00e9lections sp\u00e9ciales pour pourvoir aux postes devenus ainsi vacants, conform\u00e9ment au R\u00e8glement;<\/li>\n<\/ul>\n\n\n\n<p>Ou alors<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Elles doivent d\u00e9montrer qu\u2019aucun manquement n\u2019a eu lieu.<\/li>\n<\/ul>\n\n\n\n<p>Chaque association \u00e9tudiante doit prendre les mesures exig\u00e9es par l\u2019Universit\u00e9, ou alors d\u00e9clarer par \u00e9crit qu\u2019elles sont d\u2019avis qu\u2019elles n\u2019ont pas enfreint au R\u00e8glement, au plus tard \u00e0 17&nbsp;h le mercredi 25 octobre 2023. Toute association qui nie toute infraction au R\u00e8glement sera convoqu\u00e9e \u00e0 une audience en bonne et due forme visant \u00e0 d\u00e9terminer s\u2019il y a eu infraction, ce qui pourrait la rendre passible de sanctions pouvant aller jusqu\u2019au retrait de la reconnaissance de l\u2019Association par l\u2019Universit\u00e9.<\/p>\n\n\n\n<p>L\u2019Universit\u00e9 est profond\u00e9ment d\u00e9\u00e7ue de devoir prendre cette mesure, mais il nous incombe de faire respecter les politiques universitaires et d\u2019agir dans l\u2019int\u00e9r\u00eat de la communaut\u00e9 de York, y
